CHOOSING YOUR PATH TO U.S. PERMANENT RESIDENCY

Affidavit of Support – An Integral Part of Your Family Immigration Journey
Sponsoring a family member for U.S. permanent residency involves more than just navigating the legal pathways. It also involves a commitment to their well-being and financial stability as they transition into a new life in the United States. One of the ways this commitment is demonstrated is through the Affidavit of Support. The Affidavit of Support (Form I-864) is a crucial document in the family-based immigration process. As a U.S. sponsor, you are required to submit this form, serving as a legally enforceable pledge of your financial support towards the family member you are petitioning.

Why is the Affidavit of Support necessary?
The Affidavit of Support underscores the sponsor’s commitment to safeguarding the U.S. government’s resources. It ensures that the immigrant does not become reliant on public assistance programs, reflecting the ethos of self-sustainability central to the American dream.

How does it work?
The U.S. sponsor promises to maintain the incoming family member’s income at a minimum of 125% of the Federal Poverty Guidelines. Should the immigrant receive public benefits, the U.S. government can legally demand reimbursement from the sponsor. This responsibility continues until the immigrant either becomes a U.S. citizen or can be credited with 40 quarters of work (typically 10 years).
